FDA Advisory Committee Signals New Regulatory Expectations for Generative AI in Digital Mental Health: What Innovators Need to Know Now
On November 6, 2025, the FDA’s Digital Health Advisory Committee met to examine one of the fastest-growing areas in healthcare technology: generative AI–enabled digital mental health (DMH) tools. Digital mental health solutions are not new, but the rise of large language models (LLMs) and adaptive conversational systems is transforming how support, therapy, and patient triage are delivered.
The Digital Health Advisory Committee—composed of experts from across industry, academia, and clinical practice—serves to advise the FDA on emerging issues. This session did not create new regulations. Instead, it offered a clear signal about the direction the Committee believes the FDA should take: greater structure, tighter oversight, and stronger expectations for scientific validity and safety.
While it remains to be seen how the FDA will act on these recommendations, the message to stakeholders is clear: now is the time to engage and help shape the agency’s evolving approach to generative AI in mental health care.

Tools that provide coaching, tracking, or general emotional support may fall outside regulation. But tools that deliver therapy, measure symptoms, or influence treatment decisions typically qualify as medical devices reviewed through the 510(k), De Novo, or PMA pathways.
Because no GenAI-enabled DMH devices have yet been cleared, most will not have an eligible predicate device—meaning many will likely proceed through the De Novo pathway.

1. Expect a New Risk Taxonomy for GenAI Mental Health Tools
The Advisory Committee emphasized the need for clear categories based on:
Intended use
Level of autonomy
Clinical supervision requirements
This taxonomy will guide what evidence is required and what safety guardrails are mandatory.
Takeaway: A new taxonomy framework will provide much needed clarity, but developers should define your product’s role and claims now, not later. Small shifts in claims may trigger large differences in regulatory requirements.
2. Model Confidence Guardrails and the “Unknown Unknowns” Problem
GenAI systems perform well when predicting familiar patterns but can generate confident but incorrect responses when addressing unexpected scenarios such as delusions or hallucinations, self-harm ideation, or trauma responses.
To help mitigate risk, the Committee recommends FDA require more stringent:
Uncertainty detection mechanisms
Escalation and referral workflows
Limits on the system’s scope and tone
Takeaway: Build safety into the base architecture, not as a later feature. Clearly address how your system recognizes uncertainty, limits overreach, incorporates escalation protocols, and handles high-risk inputs.
3. Multi-Layer Model Drift Must Be Monitored and Managed
Most GenAI DMH tools rely on:

A health-specific fine-tuning layer
Ongoing updates over time
This structure creates a risk unique to GenAI-powered DMH tools: multi-layered drift where the base model may drift independently from the DMH tool’s own updates. Because both the foundational and fine-tuned layers can change independently, drift detection and mitigation become more complex.
As a result, the Committee recommended the need for FDA scrutiny of:
Drift detection
Update and audit trails
Model update and change plans
Implication for developers: Prepare now for continuous monitoring and documented update governance to address multi-layer drift monitoring and validation.
4. Evidence Requirements Expand Beyond Symptom Scores
Traditional DMH endpoints (e.g., PHQ-9) may not adequately capture:
Emotional safety
Engagement quality
Comprehension accuracy
Sustained clinical benefit over time
The Committee recommends that FDA require more holistic and longitudinal study designs, including:
Suitable control arms
Alternatives to traditional endpoints (beyond PHQ-9)
Broader definitions of adverse events

Scope creep beyond intended use
The Committee’s consensus leaned strongly toward limiting GenAI DMH devices (and to a lesser degree, DMH devices in general) to provider-supervised settings.
Takeaway: Assume clinician-in-the-loop requirements for moderate- and high-risk use cases. Those contemplating OTC market pathways should be prepared for increased scrutiny, more robust clinical evidence requirements, and stronger safety controls, such as role and scope reminders, and disclaimers and disclosures.
What Digital Mental Health Innovators Should Do Now
Lock in Your Intended Use and Claims Strategy. Your language and functionality claims determine your regulatory path. Be prepared for fewer gray areas and increased scrutiny of “wellness” products.
Build Safety, Monitoring, and Guardrails Into the Core, NOT as add-ons. Develop monitoring across both foundational and fine-tuned model layers, supported by a strong PCCP.
Develop Your Evidence Plan Early. A clinical strategy is now as critical as a product roadmap. Control arms, endpoints, diversity of study populations, and placebo effect considerations will be critical for success.
Prepare for Continuous Postmarket Surveillance. FDA will expect real-time monitoring—not just periodic reporting. Plan for robust postmarket monitoring of measurable safeguards.
Assume provider involvement as the baseline. Most GenAI DMH products will likely require some degree of clinical supervision. Plan how your product will fit into the clinical workflow.
