We’ve had a whirlwind couple of weeks around here, and we’re excited to share three big things right away.

  2. We were at ViVE2024 in LA last week, and everyone was talking about AI and LLMs (including Rebecca). If you’re curious about AI law and policy for digital health innovators, be sure to sign up for our webinar on March 14.   3. If you’re using pixels and cookies to tailor advertising for your direct-to-consumer digital health and telemedicine solutions, you’ll want to understand these recent actions from the Department of Health and Human Services Office of Civil Rights (OCR) and the Federal Trade Commission (FTC). FTC and OCR are holding digital health companies accountable for violations of consumer privacy laws related to the use of tracking technologies for performance marketing and behavioral advertising. The consequences of failing to implement safeguards around these activities can be steep, especially for young companies. We’ve got a simple list of actions you can take right now to safeguard your company.

Conference Schedule

New Partner Mike Pappas traveled to LA with Carrie and Rebecca for all things ViVE2024 last week.


Carrie spoke at a panel on transforming employer-sponsored health plans. A new program will test the theory that a value-based plan, combined with proactive care navigation, can decrease barriers to access and help clear the path to more equitable healthcare for American workers.

On the East Coast, Partner Kaitlyn O’Connor and Counsel Aizaz Chaudhary went to Tampa, Florida for the International Virtual Reality Healthcare Association (IVRHA) Global Symposium this weekend. Kaitlyn led an intensive workshop on How to Commercialize in Healthcare: Reimbursement and BusinessModeling.


The Don’t Miss List

  • The FDA's Center for Devices and Radiological Health is accepting proposals by March 8th at noon EST from sites interested in hosting staff virtually or in-person for the Spring 2024 Experiential Learning Program. The program provides CDRH staff with insights into medical devices, technologies, industry practices, and patient needs through one-day or multi-day visits.

    • Attorney Michael Schellhous says, “The FDA has listed "Digital Health" as one of their target areas for the program this year and that they want to better understand (1) predictive and generative AI model system performance, and (2) home use digital health technologies. This could be a good way for your business to make some additional connections within CDRH and help educate the FDA in a positive way on these technologies.”

  • The AMA released the agenda for the May 2024 CPT panel meeting, and it includes remote monitoring and a few AI-related proposals. Check out the agenda here.
